Terms of Service

1. Agreement to Terms

By purchasing, downloading, installing, or using AuroraNTFS ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Software.

3. License Grant and Restrictions

3.1 License Type

AuroraNTFS is licensed, not sold. Upon payment of the license fee ($24 USD one-time payment), you are granted a non-exclusive, non-transferable, revocable license to use the Software on a single Mac computer.

3.2 Hardware Binding

Each license key is permanently bound to the hardware identifier (serial number and UUID) of the Mac computer on which it is first activated. The license cannot be transferred to another computer without explicit authorization from SvarogSoft.

You may NOT:

• Copy, distribute, or share your license key with others
• Use the Software on more than one computer simultaneously
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
• Modify, adapt, translate, or create derivative works based on the Software
• Remove, alter, or obscure any proprietary notices on the Software
• Use the Software for any illegal or unauthorized purpose

4. User Responsibilities and Liability

4.1 Data Backup

YOU ARE SOLELY RESPONSIBLE for maintaining backups of all data stored on NTFS volumes accessed through the Software. SvarogSoft strongly recommends creating complete backups before using the Software for the first time and maintaining regular backup schedules thereafter.

4.2 Proper Use

You agree to:

• Use the Software only on compatible macOS systems (macOS 13 Ventura or later)
• Follow all installation and usage instructions provided in the documentation
• Report any bugs, errors, crashes, or unexpected behavior to [email protected]
• Keep your macOS system and the Software updated to the latest available versions

4.3 Assumption of Risk

BY USING THE SOFTWARE, YOU ACKNOWLEDGE AND ACCEPT ALL RISKS associated with accessing, reading, writing, modifying, or deleting data on NTFS volumes. You understand that file system operations carry inherent risks of data loss or corruption, and you assume full responsibility for any consequences resulting from your use of the Software.

5. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Software will be error-free, uninterrupted, secure, or free from viruses or other harmful components
• Warranties regarding the accuracy, reliability, or completeness of any data accessed through the Software

SvarogSoft does not warrant that the Software will meet your requirements or expectations.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SVAROGSOFT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

• DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF DATA, PROFITS, REVENUE, BUSINESS, OR GOODWILL
• COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES
• SYSTEM FAILURES, MALFUNCTIONS, OR DOWNTIME
• DATA CORRUPTION, LOSS, OR UNAUTHORIZED ACCESS

This limitation applies whether the claim is based on contract, tort (including negligence), strict liability, or any other legal theory, even if SvarogSoft has been advised of the possibility of such damages.

IN NO EVENT SHALL SVAROGSOFT'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE LICENSE ($24 USD).

7. Indemnification

You agree to indemnify, defend, and hold harmless SvarogSoft and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use or misuse of the Software
• Your violation of these Terms
• Your violation of any third-party rights
• Any data loss or corruption occurring on systems where the Software is installed

8. Error Reporting and Support

8.1 Mandatory Error Reporting

If you encounter any errors, crashes, data corruption, unexpected behavior, or any other issues while using the Software, you MUST report them immediately to:

Include in your report:

• Detailed description of the issue
• Steps to reproduce the problem
• macOS version and Mac model
• AuroraNTFS version
• Any error messages or crash logs

8.2 Support Limitations

Technical support is provided on a best-effort basis via email only. SvarogSoft does not guarantee:

• Response time or resolution time for support requests
• Availability of support outside normal business hours
• Resolution of all reported issues

9. Updates and Modifications

SvarogSoft may, at its sole discretion:

• Release updates, patches, or new versions of the Software
• Modify, suspend, or discontinue any aspect of the Software
• Change these Terms at any time by posting updated Terms on the website

Continued use of the Software after any such changes constitutes your acceptance of the new Terms.

10. Termination

SvarogSoft reserves the right to terminate your license immediately, without notice, if you:

• Violate any provision of these Terms
• Engage in fraudulent or illegal activities related to the Software
• Attempt to circumvent license validation or hardware binding mechanisms

Upon termination, you must immediately cease all use of the Software and uninstall it from your computer. No refunds will be provided for terminated licenses.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Software shall be subject to the exclusive jurisdiction of the courts of Poland.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and SvarogSoft regarding the Software and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding the Software.
